Acceptable Use Policy

This policy is in addition to the Cabbit Terms & Conditions:

Acceptable use of Services

  1. This Acceptable Use Policy (“Policy”) describes the prohibited uses of any services provided to you by Cabbit (“Services”).
  2. By using or accessing the Services, you are agreeing to this Policy.
  3. You are solely responsible for:
    • the content, materials and data that you create outside the Services and upload to and process on the Services;
    • the content, materials and data that you create, collect or process through your use of the Services;
    • And applications and other software that you install on the Services (together “Client Content”).
  4. This Policy applies to all uses of the Services including use resulting from or involving Client Content.
  5. You will comply with all applicable laws and regulations when using the Services and will not allow any illegal or improper use of the Services.

Changes to the Policy

  1. Cabbit reserves the right to amend or modify this Policy at any time.
  2. You are expected to check this page from time to time to take notice of any changes Cabbit make, as they are legally binding on you.
  3. Cabbit will notify you of any significant amendments of this policy.
  4. If you continue to use the Services following a change to this Policy you will be deemed to have accepted the change.

Policy applies to all Users

  1. This Policy applies to the use of the Services by all your users, your customers, third party service providers and other end-users (“Users”). You are responsible for the acts and omissions of all Users.
  2. You agree not to encourage, promote, facilitate or instruct others to undertake, or attempt to undertake, prohibited use of the Services as defined by this policy.
  3. You must ensure that any end-user submitted content (such as forum posts or chat room entries) meet with the standards defined within this Policy.

Security

  1. Your use of the Services must be configured to prevent unauthorised use or access.
  2. You must not disable, interfere with, abuse, disrupt, circumvent or otherwise violate the security of Cabbit’s Services or another’s use of the Services.
  3. You may not use the Services or allow the Services to be used to:
    • gain unauthorised access to computer systems or engage in security attacks of any kind including:
      • against trust (such as email spoofing, password cracking, IP spoofing and DNS poisoning);
      • against confidentiality and integrity (by using malware such as computer viruses, worms, trojan horses, rootkits, keyloggers, spyware or other malicious programs and code);
      • or against availability (such as denial of service and email bombs);
    • corrupt, modify or intercept electronic communications intended for any other person or entity;
    • corrupt, modify or destroy web site content or other information;
    • or interfere with or disrupt the operation of Cabbit’s services or another’s use of the Services.
  4. You must comply with any limitations Cabbit place on your use of the Services.

Abuse and Illegal Behaviour

You may not use the Services to:

  1. breach any applicable laws, regulations, or government requirements of any jurisdiction;
  2. conduct or engage in any fraudulent or illegal business or activity, for example;
    • export control violations;
    • fraud;
    • forgery;
    • pyramid or other prohibited business schemes;
    • theft, misappropriation, or unauthorised transmission or storage of funds, credit card information, personal information, or online services;
    • solicitation or sale of any harmful/illegal products or service.
  3. infringe any third party intellectual property right, for example;
    • copyrights;
    • patents;
    • trademarks;
    • trade secrets or know-how.
  4. participate in any file-sharing/peer-to-peer activities that infringes any third party intellectual property right;
  5. provide information, instructions, links, etc containing malicious code;
  6. collect, copy or process information in a way that breaches data protection laws or leads to a wrongful breach of privacy, for example;
    • Misrepresentation of member’s identity, or impersonation;
    • Collection of personal information for illegal purposes;
    • Collection of personal information without users permission.
  7. create, distribute, process or view any:
    • defamatory;
    • obscene, indecent or illegal material, including child pornography;
    • racist, sexist or otherwise discriminatory;
    • misleading, deceptive or fraudulent;
    • hate speech or hate propaganda;
    • or otherwise objectionable or offensive material.
  8. be abusive, threatening or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.

Email and Spam

  1. You may not use the Services to distribute email, instant messages, text messages or other communications in an unacceptable or illegal manner. For example, you may not:
    • create or send hoax emails or chain emails;
    • send unsolicited commercial email or bulk email (“spam” or “spamming”);
    • harvest email addresses;
    • use open proxies or relays to allow spamming;
    • or impersonate someone else (“spoofing”) or falsify message header information.
  2. All commercial email promoting goods or services you send using the Services must comply with all applicable laws, rules, regulations, industry codes and similar guidelines.

Data Protection

  1. As Cabbit’s customer, you use the Services to host, transmit or process data on Cabbit’s hosting platforms, which may include personal data of your customers.
  2. For the avoidance of doubt, under these circumstances, you stipulate the process for collecting your customer’s personal data. Most importantly, Cabbit do not have knowledge of or view, share, collect or process this personal data.
  3. Cabbit’s relationship is with you directly, there is no agreement in place between Cabbit and your customers, and you are responsible for any applicable regulatory or legal requirements in respect of your customers’ personal data.
  4. You are responsible for:
    • complying with any applicable data protection regulations with respect to your customers personal data;
    • managing the security of your customers personal data, including backups;
    • ensuring secure access to such data.

Suspension or Termination

  1. Cabbit will determine, in its discretion, whether there has been a breach of this Policy through your use of the Services. Whilst Cabbit do not routinely monitor, or censor, the use of the Services, when a breach of this policy has occurred, Cabbit may take such action, as it deems appropriate.
  2. If you breach this Policy or misuse the Services, or allow others to do so, Cabbit may suspend or terminate your use of the Services.
  3. Failure to comply with this Policy constitutes a material breach of our Terms and Conditions upon which you are permitted to use the Services, and may result in Cabbit taking all or any of the following actions:
    • immediate, temporary or permanent withdrawal of your right to use the Services;
    • immediate, temporary or permanent removal or archiving of any content that is abusive or illegal (as defined in section 5 of this Policy);
    • block access to any content that is abusive or illegal (as defined in section 5 of this Policy);
    • issue of a warning to you;
    • issue of legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
    • further legal action against you;
    • disclose of such information to law enforcement authorities as Cabbit reasonably feel is necessary or are legally required to do so.
  4. When appropriate, Cabbit allow a defined period of notice during which violations may be addressed voluntarily. However, Cabbit reserve the right to act without notice.
  5. Cabbit does not accept liability for actions taken in response to breaches of this Policy. The responses described in this Policy are not limited, and Cabbit may take any other action reasonably considered appropriate.
